Damages claims

"Damages" means monetary compensation for loss or injury caused by a breach of contract or by some other unlawful act.

Unlawful termination

The situation that most frequently gives rise to a damages claim is where, without justification, one party terminates an agency and/or distribution contract before the end of an agreed fixed period, or without giving proper notice of termination to the other party.  In such a case, the party terminating will be in breach of contract and liable to pay damages for the loss the other party suffers in consequence.

Subject to legal rules as to proof and recoverability of damages, the claimant will in principle be entitled to damages in respect of ............
